TMZ’s Harvey Levin on Usher and Ex’s Battle After Son’s Pool Accident

Ushers ex-wife Tameka Foster is taking the singer back to court and seeking custody of their two children after their eldest son, 5-year-old Usher Raymond V, nearly drowned on Monday.

TMZ’s Harvey Levin phoned in to On Air with Ryan Seacrest to explain: “She’s really had beef with Usher for years now … she lost [custody battle] initially and now she’s going in to court tomorrow to ask an Atlanta judge to change the custody arrangement … She’s claiming Usher is an absentee father, gone 85% of the month and leaves the two kids with various people, some of whom are not qualified to handle the kids.

Harvey continues: “She’s suggesting the aunt who was watching Raymond Usher V was asleep at the wheel and she’s saying he’s putting the kids in danger so she wants full custody.”

However, Harvey doesn’t agree with Tameka. “I don’t think it will happen and here’s why. This happened very quickly. The aunt who was watching the kid was there. All the kid did was dive down to the bottom of the pool to get a toy and that’s when his arm got stuck in a drain. She immediately jumped in and tried to free him, couldn’t do it, screamed, got the maid and thank god there were two guys doing audio-visual work in the house who jumped in and saved him.”

Adding that the 5-year-old will be okay, Harvey concludes, “Unless a judge says you need a stronger care taker, which I don’t think he will say, I don’t feel like she’s going to win this.”
